
REFUGEE CLAIMS AND HUMANITARIAN APPLICATIONS
We help with obtaining protection as refugees in Canada and permanent residency on humanitarian grounds.
REFUGEE CLAIMS
If an individual flees their home country, Canada offers them protection in one of the following bases:
- Having a well-founded fear of persecution for reasons of race, religion, nationality, membership in a particular social group or political opinion, or
- If sent back to their country of persecution would be at risk of torture, risk to their life, or a risk of cruel and unusual treatment or punishment.
HUMANITARIAN AND COMPASSIONATE GROUNDS
Humanitarian and compassionate grounds are considered an exceptional basis for applying for residence in Canada. If your circumstances are justified, the Minister may grant permanent residency status under Section 25 of the Immigration and Refugee Protection Act.
Some factors that will be evaluated are:
- Establishment in Canada.
- Ties to Canada.
- The best interests of any children affected by their application.
- Consequences of the separation of relatives.

Refugee Protection Division (RPD)
The RPD hears claims for refugee status and grants or denies convention refugee status or protected person status.
Refugee Appeal Division (RAD)
The RAD deals with the refused Refugee Claims.
Matters that cannot be appealed at IAD or RAD can be appealed to the Federal Court of Canada.
