Spouse or Common Law Partner Sponsorship Requirements

This program is a part of the family class sponsorship program. Program Requirements
Sponsor requirements
- The sponsor must be at least 18 years of age.
- The sponsor must be a Canadian permanent resident living in Canada or a Canadian citizen.
- The sponsor cannot be in prison, bankrupt, under a removal order (if a permanent resident) or charged with a serious offence.
- The sponsor cannot have been sponsored to Canada as a spouse within the last 5 years.
Sponsored person (applicant) requirements
- Must be at least 18 years old.
- The relationship is genuine (real) and was not entered into just to get permanent resident status in Canada.
Parent and Grandparent Family Class Sponsorship Requirements
for the Sponsor & the Sponsored Person
To be eligible for the Parent and Grandparent Program, both the sponsor and the person(s) being sponsored must have met certain eligibility requirements.
Sponsors must:
- be either a Canadian citizen or a permanent resident of Canada;
- meet certain income requirements (see below); and
- support the sponsored person(s) and their dependents financially.
The sponsor and the sponsored person(s) must sign a sponsorship agreement that:
- commits the sponsor to provide financial support to the sponsored person(s) and any other eligible relatives accompanying them for a period of three to 20 years, depending on their age and relationship to the sponsor, beginning on the date they become a permanent resident; and
- states that the persons becoming permanent residents will make every effort to support themselves.
The province of Quebec has additional requirements for the Parent and Grandparent Program. Residents of Quebec must sign an ‘undertaking’ with the province of Quebec. This is a contract that binds the sponsorship. Sponsors in Quebec must also meet Quebec’s sponsorship requirements after being approved as a sponsor by IRCC.
Parent and Grandparent Super Visa Sponsorship Requirements
for the Sponsor & the Sponsored Person
To be eligible for a super visa, you must:
- be the parent or grandparent of a Canadian citizen or a permanent resident of Canada
- have a signed letter from your child or grandchild who invites you to Canada that includes:
- a promise of financial support for the length of your visit
- the list and number of people in the household of this person
- a copy of this person’s Canadian citizenship or permanent resident document
- have medical insurance from a Canadian insurance company that is:
- valid for at least 1 year from the date of entry
- at least $100,000 coverage
- have proof that the medical insurance has been paid (quotes aren’t accepted)
You must also:
- apply for a super visa from outside Canada
- be allowed to enter Canada
- take an immigration medical exam
- meet certain other conditions
- You can’t include dependents in this application.
Financial support (proof of funds)
The child or grandchild who invites you must prove that their household meets the minimum necessary income. The following documents are examples of what can be used as proof of funds:
- Notice of Assessment (NOA) or T4/T1 for the most recent tax year
- Employment Insurance stubs
- employment letter including salary and date of hire
- pay stubs
- bank statements
Dependent Child Sponsorship Requirements
for the Sponsor & the Sponsored Person
As with all family sponsorship streams, both the sponsor and the sponsored person must meet eligibility requirements in order for the child to be granted permanent residence. Parents wishing to sponsor their child must:
- Be a Canadian citizen or permanent resident living in Canada
- Be at least 18 years of age
- Not be in prison, charged with a serious offense, or bankrupt
Parents will also be required to provide proof of the relationship with the child, be it through birth or adoption certificate. For parents in the end stages of an adoption process, they may sponsor the adopted child before the adoption has been finalized. In addition to meeting the definition of a dependent child, the sponsored person must either be the biological child of the sponsor or the sponsor’s spouse, or the adopted child of the sponsor or the sponsor’s spouse.
